How to obtain a Green Card by Employer Sponsored Labor Certification:
There are 3 steps to obtaining a Green Card through Employer Sponsored Labor Certification.
This is the most common path to obtaining a Permanent Residence for foreign nationals who are in the U.S. on an H-1B visa.
Step 1: Apply for Labor Certification with the Department of Labor.
To obtain an approved Labor Certification, the employer must prove (through newspaper advertising) that they were unsuccessful in recruiting enough qualified workers for a certain position.
The employer may apply through Regular Labor Certification, or Reduction in Recruitment Labor Certification.
Regular Labor Certification processing involves filing the DOL forms ETA 750A and ETA 750B and waiting for advertising instructions from the Department of Labor.
Reduction in Recruitment Labor Certification is where the employer shows the DOL that they have already unsuccessfully attempted to recruit U.S. workers for the position. In many cases 1 or 2 three consecutive day (including Sunday) advertisements in a major newspaper is sufficient. Newspaper advertising is the primary form of recruiting evidence. Internet postings, job fairs, headhunters, etc., provide good supporting evidence.
Step 2: Once the employer has received an approved Labor Certification, they may apply to the INS with the Form I-140, Immigrant Petition For Alien Worker.
Processing time for the I-140 is 1-6 months.
Step 3: Once the employer has received an approved I-140 petition, the next step is for the foreign national (and family members) to apply for Adjustment of Status.
After the foreign national applies for Adjustment of Status, he or she (and the spouse and children) will receive work authorization and advance parole (re-entry permit after foreign travel) within 90 days. He or she will then receive the Green Card in 12-24 months.
H-1B Visa.
Description
Employers in the United States that wish to employ foreigners in professional positions for "specialty occupations" may file petitions with the INS requesting H-1B status for these foreigners.
The temporary professional visa (H-1B) allows professionals to enter the United States and accept temporary employment within their profession.
This visa is often utilized by engineers, nurses, professors, researchers, computer scientist and other professionals as a means to gain valuable work experience in the United States while receiving a professional income.
The visa is subject to annual quota restrictions and is often sought by foreign nationals who have completed their professional training either in the United States or abroad.
Advantages
Permission to Work.
Allows professionals to enter the United States and accept employment in a professional capacity for a temporary period.
Earnings
The professional is allowed to receive a salaried income from the employer.
Duration
The H-1B visa is granted in increments not to exceed a total stay of six years.
Procedure
Step 1: Wage Determination Form
The employer files a Wage Determination Form with the local (state) Department of Labor to ensure that the employer is paying "the prevailing wage" for the job and the profession.
The Wage Determination Form must be certified by the Department of Labor.
Step 2: LCA . Form ETA 9035
The employer petitioning for H-1B status must file a labor condition application 'LCA' with the U.S. Dept of Labor.
The LCA (form ETA 9035) must be certified by the DOL before the H-1B petition is filed with the Dept. of Labor.
Step 3: Form I-129
The employer files with form I-129 with the INS. A decision is usually issued in two to six weeks.
